According to applicable legal provisions, the lacks of conformity of a
Product which become apparent within 24 months of delivery of the Product

that the lack of conformity did not exist at the time of the Product

- However, the Vendor is entitled not to proceed according to the Buyer’s preferred choice if such choice triggers clearly disproportionate costs compared to the other option, taking into account the value of the Product or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the Buyer.
If repair and replacement of the Product is not possible, the Buyer may
return the Product and obtain refund of the price or may keep the Product
and obtain refund of part of the price.
The same faculty is open to the Buyer:
- If the option, proposed or agreed pursuant to 8.2 and 8.3 cannot be implemented within one month following the Buyer's complaint;
- Or if this option cannot be implemented without major inconvenience for the Buyer given the nature of the Product and the use sought.
Notwithstanding the foregoing, the sale may not be cancelled if the lack of conformity is minor.
- The aforementioned guaranty applies without prejudice of Buyer’s right to bring an action on the grounds of hidden defects as provided under articles 1641 to 1649 of the French Civil Code or on the grounds of any other action of a contractual or non-contractual nature recognised by applicable law.
In any case, the aforementioned guaranty shall not apply and Vendor shall
